1. Introduction

This Refund and Cancellation Policy (“Policy”) outlines the terms under which Giritech Enterprises LLP (“Company”, “we”, “us”, “our”) handles cancellations, refunds, and related matters for its IT, software development, and technology consulting services.

By engaging our services, you (“Client”, “Customer”, “you”) acknowledge that you have read, understood, and agreed to this Policy.

2. Scope

This Policy applies to all products, services, projects, software solutions, subscription plans, and maintenance contracts offered by Giritech Enterprises LLP, unless superseded by a separate written agreement.

3. Service Nature and Deliverables

Our services involve intellectual labor, consulting, coding, and configuration work that begins shortly after order confirmation. Due to this nature, once work commences or deliverables are shared, refunds are generally not available except in specific cases outlined below.

4. Cancellation by the Client

  • Cancellations must be submitted in writing via email to info@giritech.co.in.
  • If cancellation is requested before project initiation (i.e., before resource allocation or kickoff), the Client may be eligible for a partial refund after deduction of administrative and processing fees.
  • If work has commenced, refunds will be prorated based on the stage of completion, efforts invested, and non-recoverable costs.
  • In subscription or recurring services, cancellations will take effect at the end of the current billing cycle unless otherwise agreed.

5. Cancellation by the Company

The Company reserves the right to cancel any engagement under circumstances including, but not limited to:

  • Non-payment or repeated payment delays.
  • Breach of Terms & Conditions or unlawful use of the Services.
  • Failure by the Client to provide required inputs, access, or approvals within agreed timelines.

In such cases, the Client shall not be entitled to a refund for completed or ongoing work.

6. Refund Eligibility

Refunds, if applicable, are issued solely at the Company’s discretion and only under the following limited conditions:

  • Duplicate payment made due to technical error.
  • Service not initiated due to Company’s inability to commence work after payment.
  • Mutually agreed project termination before initiation, where minimal or no work has been performed.

Refunds are not applicable once project milestones, deliverables, or development work have been completed or delivered.

7. Non-Refundable Services

The following services and fees are strictly non-refundable:

  • Domain registration, hosting, and SSL certificate purchases.
  • Third-party software or licensing costs procured on behalf of the Client.
  • Consultation or requirement analysis fees.
  • Custom software development or code-based deliverables already initiated.
  • Digital marketing, SEO, or subscription-based campaigns once activated.

8. Refund Process

  • Eligible refunds will be processed within 7–15 business days from approval.
  • Refunds are issued to the original payment method used during purchase or as otherwise mutually agreed.
  • The Client may need to provide transaction details or proof of payment for verification.
  • Bank charges, payment gateway fees, and taxes will be deducted where applicable.

9. Chargebacks and Disputes

The Client agrees not to file a chargeback without first attempting to resolve issues directly with the Company. Unauthorized or unjustified chargebacks will be treated as a breach of contract and may lead to service suspension or legal action.

10. Project Postponement or Delays

  • Projects placed on hold at the Client’s request for more than 30 days may incur storage or maintenance fees.
  • If a project remains inactive for more than 90 days without response, it will be considered abandoned. No refunds will be provided for abandoned projects.

11. Modification of Policy

Giritech Enterprises LLP reserves the right to modify this Refund and Cancellation Policy at any time without prior notice. The updated version will be posted on our website, and the “Last Updated” date will reflect changes. Continued use of our services after changes constitutes acceptance of the revised policy.
